Trademarks protect a word, name, symbol, device or combination of any
number of the four. It is for the use or intended use in commerce, such as
a logo; it identifies and distinguishes goods or services, or to indicate the
source of the goods in a free market.

TRADEMARKS
A trademark is
a word, phrase, symbol or design, or a combination of words, phrases,
symbols or designs, that identifies and distinguishes the source of the
goods of one party from those of others.
A service mark
is the same as a trademark, except that it identifies and distinguishes
the source of a service rather than a product. Throughout this booklet,
the terms "trademark" and "mark" refer to both trademarks and service
marks.
How does a trademark differ from a Copyright?
Trademarks,
copyrights and patents all differ. A trademark distinguishes the source
of the goods of one party from those of others; a copyright protects an
original artistic or literary work; a patent protects an invention.
Why use an Attorney?
An experienced
Trademark Attorney can assist you in the effective selection,
management, protection and enforcement of trademarks or service marks
for both the US and abroad. An Experienced trademark attorney can save
you time, money and can often times mean the difference between having
your trademark application accepted or rejected by the USPTO. The
reality is that filing an application for trademark registration is
something that anyone can do for themselves. However, failure to
properly file and prosecute a trademark application may result in its
refusal or improper registration. Since a trademark is a valuable
asset, it is prudent to have a knowledgeable trademark attorney guide
you throughout the trademark process to maximize your investment.
Our Experience
Eighteen years of experience with both large corporations and small
businesses has provided our group with experience in the selection,
management, protection and enforcement of trademarks for both the United
States and abroad.
